Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of maheshwariplastics.in(the “Site”) and any orders you place through it. They form a legally binding agreement under the Indian Contract Act, 1872 between you (“you”, the “Customer”) and Maheshwari Plastics (“we”, “us”, the “Seller”).

By creating an account, browsing the Site, or placing an order, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree to any of them, you must not use the Site.

We supply agricultural plastics — tarpaulins, shade nets, insect nets, weed mat, greenhouse film, and allied construction sheeting — to farmers and trade buyers across India.

• You must be at least 18 years old and competent to contract under Section 11 of the Indian Contract Act, 1872.
• You must be either an Indian resident or a registered Indian business entity. We do not currently fulfil orders to addresses outside India.
• If you are placing an order on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
• We reserve the right to refuse service, restrict orders, or terminate accounts for any user we reasonably believe is misrepresenting eligibility.

• Account creation requires a valid email address that you verify by clicking a link we send.
• You are responsible for keeping your password (and any device you are signed in on) confidential. All activity under your account is treated as yours.
• We support sign-in via Google OAuth as an alternative to password sign-in. If you use Google sign-in, your authentication is governed additionally by Google's terms.
• Notify us immediately at grievance@maheshwariplastics.in if you suspect unauthorised use of your account. We will help you regain control and review recent activity.
• We may suspend or terminate accounts that breach these Terms, abuse the Site, or are linked to fraud, chargebacks, or attempted exploits.

• All prices are in Indian Rupees (₹) and, unless explicitly stated otherwise, inclusive of applicable GST.
• Prices on each product page are shown per variant (e.g., per piece for stocked items like tarpaulins and shade nets; per cut-length for bulk-material items like weedmat and greenhouse film). The price you see on the product card is what you pay, GST included.
• Cargo / freight charges are not included in product prices or in the order total. The cargo service collects these from you in cash at the destination office on pickup. See our Shipping Policy.
• Product photographs and dimensional illustrations are indicative; actual colour may vary slightly with manufacturing batch.
• Stock availability is updated continuously but is not guaranteed at the moment you place an order. If an item becomes unavailable between cart and dispatch, we will cancel and refund that line or the entire order in full.
• We may correct typographical or pricing errors at any time. If an order has been placed at a materially wrong price, we may cancel and refund it in full before dispatch.

• Submitting an order on the Site is an offer to purchase. A binding contract forms only when payment is confirmed and we email you an order-confirmation receipt.
• Payment is online only. We accept UPI, debit and credit cards, and net banking via our payment gateway. We do not offer cash on delivery.
• Payments are processed by Razorpay Software Private Limited, a PCI-DSS compliant gateway. We never see, store, or transmit your card or UPI credentials.
• We issue a GST-compliant tax invoice for every confirmed order. Place-of-supply (intra-state CGST+SGST vs inter-state IGST) is determined by the buyer state you select at checkout.
• We may decline or cancel any order without further liability and refund the amount paid — for example where we cannot fulfil due to stock, an error in product listing, suspected fraud, or non-serviceable destination.
• For very large or made-to-order quantities, we may contact you to confirm specification and lead time before processing.

We ship from Puttur, Karnataka, via third-party cargo services (VRL Logistics or Adishakthi). Goods travel to the cargo service's office in or nearest your chosen pickup town — you collect from there. We do not offer door-to-door delivery.

• Self-service window — 1 hour after payment: open the order on your My Orders page and click Cancel order. Refund is issued automatically to your original payment method.
• After 1 hour, before dispatch: contact us via WhatsApp or raise a query on the order. If the order has not yet been dispatched, we cancel manually and refund in full.
• After dispatch: the order cannot be cancelled. Once it reaches the cargo office, please follow the returns flow if there is an issue.

Returns are accepted within 7 days of pickup for eligible reasons (damage in transit, defect, wrong item shipped). For damage in transit, documentation at the cargo office before you sign for the goods is essential.

You agree not to:

• Use the Site for any unlawful purpose, including fraud, chargeback abuse, or money-laundering.
• Place orders using stolen, unauthorised, or otherwise compromised payment instruments.
• Scrape, mirror, frame, or systematically copy any portion of the Site, including prices, photographs, or product copy, without our prior written consent.
• Attempt to bypass, probe, or interfere with the security or rate-limiting of the Site or its APIs.
• Upload malware, attempt to inject code, or otherwise interfere with the Site's functioning.
• Impersonate another person, misrepresent your identity, or use the Site to harass others.
• Resell products in a manner that violates Indian law (e.g., undeclared GST, sub-standard re-labelling).

All content on the Site — product photographs, descriptive text, layout, branding, logos, and source code — is owned by or licensed to Maheshwari Plastics and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. No content may be reproduced, distributed, publicly displayed, modified, or used to create derivative works without our prior written consent, except for the limited personal, non-commercial viewing necessary to use the Site as intended.

Trademarks, service marks, and trade names of third parties (e.g., logistics partners, payment gateway) remain the property of their respective owners.

Products are sold “as described” on their respective product pages. Beyond the manufacturer's express specifications (GSM, dimensions, UV stabilisation claims, etc.), we make no other warranty — express or implied — regarding suitability for a particular crop, climate, soil, or installation method.

You are responsible for verifying that the chosen product suits your agronomic use-case. If you are unsure, please contact our Customer Care before ordering.

To the maximum extent permitted by Indian law, our total aggregate liability arising out of or in connection with an order — whether in contract, tort (including negligence), strict liability, or otherwise — is limited to the amount actually paid by you for that specific order.

We are not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages — including loss of crop yield, loss of profit, loss of business, loss of data, or loss of goodwill — even if we were advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Maheshwari Plastics, its partners, employees, and agents from and against any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) any misuse of the Site or products by you or anyone using your account; or (d) any false or misleading information you provide.

We are not liable for any delay or failure to perform our obligations under these Terms caused by circumstances beyond our reasonable control, including acts of God, natural disasters, floods, fires, epidemics or pandemics, war, terrorism, civil unrest, government action, cargo-service strikes or shutdowns, transport blockades, internet or power outages, or failure of third-party payment gateways.

If a force-majeure event extends beyond 30 days, either party may terminate the affected order and we will issue a full refund of any amount paid for undispatched goods.

We may suspend or terminate your access to the Site and/or your account, with or without notice, if we reasonably believe you have breached these Terms, used the Site fraudulently, or engaged in conduct that could expose us or other users to harm or legal liability.

You may close your account at any time by contacting our Grievance Officer. Closure does not erase order records we are required to retain under tax and accounting laws (see our Privacy Policy).

We may update these Terms from time to time to reflect changes in our services, regulatory requirements, or operational practices. The “Last updated” date at the top of the page will reflect the most recent revision. Material changes will be highlighted via an in-site banner or email notice. Your continued use of the Site after a change constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to mandatory consumer-protection forums, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or any order shall be subject to the exclusive jurisdiction of the competent courts at Puttur, Dakshina Kannada district, Karnataka.

Nothing in this clause prevents a consumer from approaching a Consumer Commission having jurisdiction over the place where they ordinarily reside.

If any provision of these Terms is held by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
